Terms of Service

Read carefully. These Terms of Service are a legally binding agreement.

These Terms of Service (“Terms”) govern travel-planning services provided by Wyn and Wander LLC, a Virginia limited liability company (“Wyn and Wander,” “we,” “us,” or “our”), and your use of our website. By purchasing or using our services, you agree to these Terms for yourself and for every traveler included in your request whom you are authorized to represent.

1. Definitions

“Traveler,” “you,” or “your” means the person purchasing or using the services and each traveler included in the request. “Services” means the travel-planning services described in your written proposal, order, or confirmation. “Third-Party Provider” means any independent supplier, including a hotel, tour operator, restaurant, transportation company, insurer, or other travel provider.

2. Changes to These Terms

We may update these Terms from time to time. The version in effect when you purchase Services will govern that engagement unless a change is required by law or you agree to an update in writing.

3. Services and Package Scope

Full Service Planning. Full Service includes a personalized day-by-day itinerary plus research and booking assistance for agreed non-flight trip components, which may include accommodations, activities or tours, dining, transfers, and ground transportation. Airline ticket research or booking is not included unless expressly added in a written proposal.

Wyn & Wander Lite. Lite includes a general trip overview and curated recommendations. It does not include daily scheduling, booking assistance, trip management, or concierge-style support.

The exact destinations, dates, travelers, deliverables, and included components are defined in your written proposal or confirmation. We provide planning and advisory services; we are not the owner, operator, or direct provider of any travel product or service supplied by a Third-Party Provider.

4. Revisions, Changes, and Support

Reasonable refinements within the agreed scope are included before final delivery. Material changes—including new destinations, substantially changed dates or trip length, additional travelers, replacement research after prior approval, rebooking, or new categories of work—may require a revised quote or additional fee, disclosed for your approval before the additional work begins.

Any trip support included with Full Service is limited to reasonable questions about the delivered itinerary and agreed bookings. It is not on-call, after-hours, emergency, or concierge service. Lite does not include ongoing trip support. Emergency assistance, rebooking, or other out-of-scope work is available only if we agree in writing and may carry an additional fee.

5. Fees and Payment

Planning fees are based on the selected package, trip length, and the scope stated in your written quote. Any rush or complexity fee will be disclosed and approved before purchase. Any advertised military discount is 10% off the base planning fee only and does not apply to rush fees, complexity fees, add-ons, or Third-Party Provider charges.

Unless your written quote states otherwise, payment is due in three installments: a non-refundable 33% deposit to begin work; 33% when the itinerary framework or major components have been identified; and the final 34% before final delivery. Third-party travel costs are separate from our planning fees and remain your responsibility.

6. Cancellation, Refunds, and Rebooking

Because our work is customized, planning fees are generally non-cancellable and non-refundable once work begins. If you cancel in writing within 24 hours after purchase and before substantive planning begins, a full refund may be considered. The initial deposit is otherwise non-refundable. Any approved refund will be limited to fees attributable to work not yet performed. No refunds are available after the second installment or final payment, except where required by law. Documented extraordinary circumstances may be reviewed case by case at our discretion.

If you cancel or materially change a trip after booking assistance has been provided, you are responsible for all Third-Party Provider bookings, deadlines, penalties, credits, refunds, and terms. If available, cancellation or rebooking assistance may be offered for a separately quoted fee, generally $100–$200 depending on the work required, and will begin only after your written approval.

7. Traveler Responsibilities

You are responsible for providing accurate traveler names, dates, preferences, budgets, accessibility needs, and other information; reviewing all itinerary and booking details promptly; and notifying us of errors before applicable deadlines. You are solely responsible for passports, visas, health requirements, vaccinations, entry and exit rules, travel advisories, insurance, and compliance with all laws and supplier rules. Requirements can change without notice, so verify them with the appropriate government and provider sources before travel.

We strongly recommend appropriate travel insurance. In an emergency, contact local emergency services and the relevant Third-Party Provider. Wyn and Wander is not an emergency-response service.

8. Third-Party Providers

Third-Party Providers are independent of Wyn and Wander. Your purchase or reservation with a provider creates a contract between you and that provider and is subject to its own terms, cancellation rules, privacy practices, and availability. You authorize us to provide agreed booking assistance in your name, but you remain responsible for reviewing and accepting supplier terms and charges before confirmation.

We do not control or guarantee provider performance, safety, availability, pricing, schedule changes, cancellations, refunds, or representations, and we are not responsible for a provider’s acts, omissions, insolvency, or changes.

9. Limitation of Liability

To the fullest extent permitted by law, Wyn and Wander will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost enjoyment, lost profits, delay, missed connections, or costs caused by a Third-Party Provider or events outside our reasonable control. Our aggregate liability arising from the Services will not exceed the planning fees you paid to us for the affected engagement. Nothing in these Terms excludes liability that cannot lawfully be limited.

10. Indemnity

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Wyn and Wander and its owners, employees, and contractors from claims, losses, costs, and reasonable legal fees arising from inaccurate information you provide, your violation of these Terms or law, your acts or omissions, or claims by travelers you included without authority.

11. Website, Content, and Intellectual Property

You must be at least 18 years old to purchase Services. Website access may be changed or interrupted without notice. Site content and our original planning materials are owned by or licensed to Wyn and Wander and may not be copied, sold, republished, or used commercially without written permission. You may use your final itinerary for personal, non-commercial travel by the travelers included in the engagement.

12. Privacy, Communications, and Feedback

Our Privacy Policy explains how we handle personal information. By contacting or purchasing from us, you consent to service-related electronic communications. Marketing messages may be unsubscribed from at any time. If you voluntarily submit feedback or suggestions, you grant us a worldwide, royalty-free license to use them without identifying you unless you separately authorize identification.

13. Governing Law, Venue, and Severability

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. Any dispute must be brought in a court of competent jurisdiction in Virginia, unless applicable law requires otherwise. If any provision is found unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions will continue in effect.

14. Entire Agreement and Contact

These Terms, our Privacy Policy, and your written proposal or order form the entire agreement concerning the Services and replace prior discussions on the same subject. If a written proposal conflicts with these Terms about package scope or price, the proposal controls only for that scope or price; these Terms otherwise remain in effect. A waiver must be in writing and applies only to the specific instance stated.
